The warranty obligations of Peruna Glass, Inc., d/b/a Glass Doctor of North Texas (“Glass Doctor”) for this product and service are limited to the terms set forth below in this Limited Warranty (the “Warranty”):
Glass Doctor provides a transferrable limited workmanship warranty of two years on all services it provides. (Please read Non-Single-Family Building exclusions and limitations if applicable).
To be eligible for any remedies offered by Glass Doctor pursuant to this Warranty, the services and products subjected to this Warranty must be paid in full.
Glass Doctor will honor operative and applicable manufacturer warranties on all products sold and will replace those products once during the manufacturer’s warranty period. The cost of installation, any other materials required for replacement, and/or special equipment (i.e. scaffolding or lifts) necessary for installation is not included in the warranty and will be charged to the customer.
Glass Doctor wants you, the customer, to enjoy your purchase. It is important to note that glass and metal both possess natural imperfections that can result in minor scratches, rubs, bubbles, knots, and other imperfections. Glass Doctor uses ASTM International inspection standards to determine if a product is acceptable. ASTM inspection standards employ a 120” viewing distance. At Glass Doctor, we employ a more stringent standard, which is more favorable to you, and inspect our products from a 60" distance. If the product displays ASTM industry-defined imperfections from that distance, Glass Doctor will honor all applicable warranties.
A $75.00 Warranty Assessment Fee will be required for any warranty assessment. This fee is fully refundable to the customer if it is determined that a valid warranty claim with no chargeable items exists. Otherwise, the assessment fee will be applied to the cost of any work performed or retained if no work is performed.
Warranty Exclusions and Limitations
Glass Doctor disclaims any and all warranties on any materials you supply, regardless of whether or not the materials are new or used. Glass Doctor disclaims any and all warranties and expressly disclaims all liability with respect to any repair, adjustment, or remediation on your existing materials or building components.
This Warranty does not cover any defects or seal failure due to improper use or handling, glass breakage, faulty building construction or design, structural movement, repeated exposure of insulated glass to water by sources other than naturally occurring rain, damage from acts of God, abnormal stress due to heat or load application, sloped glazing, installation into refrigeration or heating compartments, saunas, steam rooms, swimming pool areas, any films or tints applied to the glass, leaks, stress cracks, or related damage in connection with installations to vehicles having damage or rust on the pinch weld.
Insulated Units: Warranties for insulated units exceeding 30 square feet or consisting of laminated glass are limited to five (5) years from the date of purchase.
Butt Glazed Glass: Warranties for butt glazed insulated or monolithic glass units are limited to one (1) year from the date of purchase.
Adjustments / Wear and Tear: Normal adjustments or wear and tear on purchased items are not covered. Adjustment to operational parts such as shower doors and window sashes, replacement of sweeps, or leaking from non-caulked openings is also not covered under this Warranty.
Windshield repair warranty: The repair process involves the injection of special adhesives into the damaged part of the glass. The degree of success of each repair is a function of several variables. The best results are obtained when the damage is recent, the point of an impact small, the cracks around the damaged area are small, and there is no moisture or other foreign matter in the damaged area. In some cases, the attempt to repair a windshield can result in the chip or crack becoming larger, and we are not responsible for such damage. Our windshield warranty works as such: if you are dissatisfied with the repair, we will credit the cost of repair toward replacement. If your insurance company paid for the repair, the insurance company will receive credit. We guarantee that the repaired portion of the windshield will not crack further and that the repair will pass any state vehicle inspection, or we will credit the cost of repair toward replacement.
Non-Single-Family Buildings: Non-single-family buildings are provided a one-year workmanship warranty. Non-single-family buildings will be charged for labor to replace products covered by a manufacturer’s warranty after the expiration of the one-year workmanship warranty. If Glass Doctor elects to supply a replacement Product, any Limited Warranty that would otherwise apply to such replacement Product will only extend for a Limited Warranty Period equal to the remaining balance of the original Limited Warranty Period for the defective Product.
To the maximum extent permitted by law, this Warranty and remedies are exclusive and are made expressly in lieu of all other warranties, expressed or implied, whether in fact or by operation of law, statutory or otherwise. Glass Doctor neither assumes nor authorizes any third party to assume for it any other liability in connection with the sale, installation or use of our products and services.
THE PRODUCTS AND SERVICES OFFERED BY GLASS DOCTOR ARE INTENDED TO CONFORM TO GLASS DOCTOR’S SPECIFICATIONS; THEREFORE, GLASS DOCTOR EXPRESSLY DISCLAIMS THE IMPLIED WARRANTY OF MERCHANTABILITY. GLASS DOCTOR FURTHER DISCLAIMS THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
The liabilities of Glass Doctor are limited solely and exclusively to, and shall not exceed, the replacement price for the products and services it provides, and do not include any liability for any direct, incidental, consequential, special, exemplary, punitive, or other damages of any kind whatsoever, nor does it include any liability regarding any duties, whether arising based on theories of contract, negligence, warranty, statute, or tort, (WHETHER SUCH OCCURRENCE ARISES OUT OF GLASS DOCTOR’S SOLE OR CONCURRENT NEGLIGENCE OR BREACH OF ANY STANDARD OF STRICT LIABILITY), or any other legal theory, and without any limitation, does not include any other losses or expenses related to or associated with any inspection.
This written Warranty shall not be varied, modified, supplemented, qualified, or interpreted by any prior course of dealings or any prior or subsequent oral agreements. To obtain a remedy under this Warranty, please contact Glass Doctor.
